OSB MANUFACTURING
The Owner undertook the design and construction of two fast-tracked green-field Oriented Strand Board (OSB) plants. The Electrical Contractor (EC) made claims of defective design and increased scope, and the steel Fabricator/Erector (FE) made claims of delay. After our negotiations with the FE, it withdrew its claim. The EC filed for arbitration, and we defended the Owner. An Expert Report was prepared, and Expert Testimony was provided at deposition and arbitration.
SEMICONDUCTOR WAFER FABRICATION
Working for the Design Build Contractor (DBC), a Risk Assessment Team was established to evaluate the design and construction of a new fabrication plant in Singapore. The Risk Analysis Report identified several areas of financial risk for the DBC, and recommended procedural changes to mitigate the risk of design changes impacting construction costs.
PHOSPHATE ORE BENEFICIATION
A Contractor (GC) held three contracts for the construction of a phosphate ore processing plant. The design-builder (EPC) terminated two of the three contracts for cause. Our defense of the GC included an evaluation of a) status of the progress at notice to cure and at termination, b) acceleration, c) completion costs, d) justification for the termination, and e) damages. An Expert Report was issued, and Expert Testimony was provided at deposition and at a federal jury trial.
